Welcome to the Kemtek Creative Scrapbooking digital experience (the “Service”). This Service is provided by Kemtek (Pty) Ltd (“we,” “us,” or “our”).

1. Acceptance of Terms

By accessing or using this Service, you acknowledge that you have read, understood, and agree to be bound by these specific Terms of Use. These Terms are an addendum to, and should be read in conjunction with, Kemtek’s main Terms and Conditions and Privacy Policy, which also govern your use of this website. If you do not agree with these terms, you must not use this Service.

2. The Service and Intellectual Property

Our Service is a free-to-use digital game that allows you to create scrapbook pages using a library of proprietary assets.

· Our Content: All graphic elements provided within the Service, including backgrounds, stickers, digital washi tape, fonts, and other graphic elements (collectively, “Kemtek Content”), are the exclusive property of Kemtek or its licensors and are protected by South African and international copyright laws.

· Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Kemtek Content solely for the personal, non-commercial purpose of creating digital scrapbook pages within this Service only.

· Strict Prohibitions: You are expressly forbidden from downloading, capturing, copying, distributing, selling, sharing, or repurposing any Kemtek Content for any use outside of this Service. Any such action constitutes a material breach of these Terms and an infringement of our intellectual property rights.

3. User-Uploaded Images and Acceptable Use

The Service allows you to upload a personal image (“Your Content”). In doing so, you agree to the following:

· You Are Responsible: You are solely responsible for the content of the image you upload.

· Content Standards: You agree not to upload any image that is unlawful, defamatory, obscene, pornographic, “Not Safe For Work” (NSFW), hateful, threatening, or that infringes upon the rights of any third party, including copyright and privacy rights. You must own the image you upload or have explicit permission from the legal owner.

· Automated Moderation: To maintain a safe environment, we utilise automated filtering technology (e.g., Google Cloud Vision API) to screen all uploaded images for unsafe or inappropriate content. Images flagged by this system will be automatically rejected.

· Our Right to Remove: Notwithstanding automated filtering, we reserve the absolute right to remove any image or user at our sole discretion, without notice, if we believe it violates these Terms.

4. Violation of Terms and Enforcement

· Consequences of Breach: Any violation of these Terms may result in the immediate termination of your access to the Service and the removal of any content you have created.

· Legal Action: Kemtek reserves its full legal rights to take any necessary action, including legal proceedings, against any individual who breaches these Terms, infringes upon our intellectual property rights, or uploads illegal or prohibited content. All costs associated with such legal action will be for the account of the infringing party.

5. Disclaimer

As per Kemtek’s main Legal Notice, this Service is provided on an “as-is” basis. We make no warranties regarding its continuous, uninterrupted availability. We are not liable for any damages arising from your use of the Service.

6. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of South Africa.
